前不久，北京销售市场监督管理局对祝某某某在英语自学考试中执行出轨的违纪行为作出行政处罚。该案是自教育行业行政处罚权划入销售市场监管部门至今，北京销售市场监管部门查办的首例学生考试舞弊案子，都是2015年《中华人民共和国教育法》修定后，北京查办的首例学生考试舞弊案子。在2021年10月开展的高等教育自学考试英文学科中，祝某某某违反规定将智能手机带到考试场，
偷拍照片一部分考卷具体内容发给考试场外工作人员，后将传回的回答抄录在考卷上，考试结束后又将考试题相片和回答截图在微信聊天群散播。教育主管部门发觉涉嫌违法案件线索后，于2021年12月依规将案子线索移送至北京销售市场监督管理局。通过依规证据调查，北京销售市场监督管理局根据《中华人民共和国教育法》第七十九条的要求，对双方依规做出中止参与通过自学考试1年行政许可。下一步，北京销售市场监督管理局将继续加强与教育主管部门对接相互配合，加强行纪全线贯通，根据积极主动高效率履行职责，依法查处违纪行为，为北京首都社会经济高质量发展服务保障。
这个学生是将手机带入了考场，然后把试卷的内容拍了发送给了考场之外的人员，然后又把传回来的答案抄回在了试卷上，后来就被发现了，现在已经对这个学生进行了惩罚。
据了解，在2021年10月进行的高等教育自学考试英语（二）科目中，祝某某违规将手机带入考场，偷拍部分试卷内容发送给考场外人员，后将传回的答案抄写在试卷上，考试结束后又将考题照片和答案截屏在微信群传播。教育主管部门发现涉嫌违法线索后，于2021年12月依法将案件线索移送至北京市市场监督管理局。经过依法调查取证，北京市市场监督管理局依据《中华人民共和国教育法》第七十九条的规定,对当事人依法作出暂停参加自学考试1年的行政处罚。
